5. Online Assistance Form and Product Assistance

We may provide product assistance through an online assistance form, email, phone, or other customer-service communications. Any assistance we provide is based on the information you provide and is intended as general product selection help only.
You are responsible for providing complete and accurate information, including appliance make, model, serial number, fuel type, measurements, venting configuration, installation conditions, photos, and any other requested details. We are not responsible for incorrect recommendations, incompatible parts, delayed orders, return issues, installation problems, or other losses caused by inaccurate, incomplete, outdated, or misleading information provided by you.
Our staff does not provide engineering, architectural, building code, permit, inspection, installation, safety certification, or professional trade services. You should consult a licensed installer, qualified technician, chimney professional, building-code official, engineer, or other appropriate professional before purchasing or installing any product.

6. Customer Responsibility for Product Selection, Compatibility, and Installation

You are responsible for confirming that each product is appropriate for your appliance, installation, fuel type, venting configuration, chimney system, clearances, local code requirements, building conditions, and intended use before ordering.
This includes verifying all measurements, dimensions, model numbers, serial numbers, part numbers, fuel types, clearances, venting requirements, chimney requirements, manufacturer requirements, and compatibility information.
Products must be installed and used only in accordance with manufacturer instructions, applicable laws, codes, permits, listings, clearances, and safety requirements. Improper selection, installation, venting, maintenance, fuel use, modification, or operation may result in property damage, injury, or death.
To the fullest extent permitted by law, we are not responsible for losses arising from improper product selection, incorrect measurements, incompatible parts, installation errors, code violations, misuse, modification, lack of maintenance, failure to follow manufacturer instructions, or failure to obtain required permits or inspections.

7. Orders and Order Acceptance

Your submission of an order is an offer to purchase the listed products under these Terms. We may accept or reject any order in our discretion, including due to product availability, pricing or description errors, shipping limitations, manufacturer or distributor restrictions, minimum-order requirements, suspected fraud, payment issues, or other order-processing concerns.
An order is not accepted until we issue a written order confirmation, shipping confirmation, or otherwise begin fulfillment. Automated order acknowledgments do not necessarily mean that an order has been accepted.
We may cancel or limit orders involving discontinued products, unavailable products, pricing errors, accessory-only items, flashing-only orders, suspicious activity, incorrect shipping charges, or other fulfillment issues. If we cancel an order after payment has been made, we will refund the portion of the order that was canceled.

8. Payment

Orders are billed in full when placed or when received by us, subject to order acceptance, product availability, and applicable law. We accept the payment methods shown at checkout.
We may cancel, delay, or request additional verification for orders involving payment authorization issues, suspected fraud, mismatched billing or shipping information, unusual order activity, chargeback history, high-value orders, or other security concerns.
You agree to provide current, complete, and accurate billing, shipping, contact, and payment information.

9. Pricing Errors, Availability, and Substitutions

Prices, availability, shipping charges, and product information are subject to change without notice before order acceptance.
If a product price, shipping charge, description, availability status, or other order detail is incorrect, we may contact you for instructions, request additional payment, cancel the affected item, cancel the order, or refund amounts paid.
Depending on the product and fulfillment source, we may ship from our stock, directly from a manufacturer, or from one of our distributors. We may change the carrier, shipping method, fulfillment source, or freight service when necessary or beneficial for fulfillment, provided that the substituted method does not materially reduce any service level expressly promised to you.

10. Taxes

Prices do not include sales, use, excise, or similar taxes unless expressly stated.
We collect and remit sales tax in jurisdictions where we are required to do so. Tax amounts may be estimated at checkout and may be adjusted as required by law. If we do not collect tax on an order, you may be responsible for reporting and paying any applicable use tax or similar tax directly to your state or local taxing authority.
Ohio customers may be charged applicable state, county, and local sales tax.

11. Shipping Policy

Product prices may include shipping when expressly stated. Unless otherwise stated, included or “free” shipping applies only to eligible orders over $99 shipped within the contiguous United States. The contiguous United States excludes Alaska, Hawaii, Puerto Rico, U.S. territories, U.S. possessions, military addresses, offshore locations, and international destinations.
Orders shipped outside the contiguous United States or to locations requiring special handling may incur additional shipping charges. We may contact you before fulfillment if additional shipping charges apply.
“Free shipping” means the shipping cost is included in the product price or promotional offer. Certain LTL, oversized, heavy, limited-access, special-order, manufacturer-direct, or freight items may be excluded from free shipping.
Shipping charges may include carrier costs, packaging, handling, residential delivery charges, liftgate charges, fuel surcharges, limited-access fees, appointment fees, storage fees, re-delivery fees, address-correction fees, and other carrier-assessed charges.

12. Shipping Dates and Delays

Any shipping or delivery dates we provide are estimates only unless we expressly state in writing that a date is guaranteed. We make reasonable efforts to ship within the stated timeframe.
Shipping times may be affected by product availability, manufacturer schedules, distributor delays, carrier delays, weather, labor issues, supply chain concerns, incorrect customer information, payment issues, freight limitations, force majeure events, or other circumstances beyond our reasonable control.
If we cannot ship within the stated timeframe, or within the timeframe required by applicable law where no timeframe is stated, we may contact you with a revised shipping estimate and, where required, give you the option to consent to the delay or cancel for a refund of the unshipped portion of the order.
We are not liable for delay-related damages, loss of use, labor delays, project delays, contractor fees, lost profits, missed installation appointments, or other consequential losses caused by shipping or delivery delays, except as required by law.

13. Risk of Loss and Delivery

Risk of loss generally passes to you when the product is delivered to the shipping address, received by you or your representative, or otherwise deemed delivered by the carrier, subject to applicable law and any carrier claim rights.
You are responsible for providing a correct, complete, and deliverable shipping address. Additional charges may apply for incorrect addresses, address changes, missed deliveries, re-deliveries, storage, refused shipments, limited-access locations, or carrier-assessed fees.
Do not schedule installation, contractors, inspections, or related work until you have received and inspected all products and confirmed that they are complete, undamaged, correct, and suitable for your installation.

14. Common Carrier / Semi-Truck / LTL Freight Shipments

Large, heavy, oversized, or bulky products may ship by common carrier, LTL freight, semi-truck, tractor-trailer, 18-wheeler, or similar freight service. This may include wood stoves, gas stoves, pellet stoves, fireplaces, large pipe orders, chimney systems, and other large items.
Freight delivery is typically curbside only unless we expressly agree otherwise in writing. The customer is responsible for ensuring that the delivery location is accessible to the carrier. The customer may also be responsible for providing unloading assistance, equipment, liftgate service, appointment availability, or additional labor.
Additional charges may apply for liftgate service, inside delivery, limited-access locations, residential delivery, appointment delivery, missed appointments, re-delivery, storage, detention, address corrections, refused shipments, or other carrier-assessed fees.

15. Freight Inspection Requirements

Damage during freight shipment is uncommon but can occur. You must inspect freight shipments carefully before signing the bill of lading, delivery receipt, or similar carrier paperwork.
Before signing, you should:
1. Inspect the outside of the shipment and packaging.
2. Look for dents, holes, crushed corners, broken pallets, torn shrink wrap, punctures, water damage, missing items, or other visible issues.
3. Open and inspect individual pieces when possible.
4. Photograph the shipment, packaging, labels, and any visible damage.
5. Note all damage or suspected damage clearly on the delivery paperwork before signing.
6. Keep all packaging until the issue is resolved.
The bill of lading or delivery receipt may be used by the carrier as evidence that the shipment was delivered in good condition. Signing without noting damage may limit or prevent recovery for freight damage.
If you cannot fully inspect the shipment at delivery, write “possible concealed damage” or similar notation on the delivery paperwork before signing.
If visible damage has occurred, you should refuse the damaged shipment when appropriate and contact our sales staff immediately.
Failure to inspect, photograph, preserve packaging, or note damage on delivery paperwork may limit our ability to assist with a freight claim and may affect available remedies to the fullest extent permitted by law.

16. Concealed Freight Damage

Concealed freight damage is damage that is not reasonably visible at delivery. Concealed damage must be reported to us within 5 business days after receipt of the shipment.
You must provide photographs of the damaged product, packaging, shipping labels, pallet, delivery paperwork, and any other requested documentation. You must keep all packaging and materials until the claim is resolved.
Depending on the circumstances and at our discretion, we may assist with a carrier claim, send replacement parts, arrange for repair, replace the product, or offer an alternative remedy. Some remedies may require manufacturer, distributor, or carrier approval. In some cases, replacement parts, repair, freight, or other costs may be the customer’s responsibility, except as required by law.

17. UPS, FedEx, Parcel, and Ground Shipments

For UPS, FedEx, USPS, parcel, or ground shipments, you must promptly inspect all items after delivery, even if the box appears undamaged.
Shipping damage for parcel or ground shipments must be reported within 3 working days after delivery. You must provide photographs of the damaged item, packaging, labels, and any other requested documentation. Keep all packaging until the issue is resolved.
If you find that your shipped item is damaged, please contact us promptly and complete the applicable damage claim form or process we provide.

18. Shipping Damage vs. Product Defects

Shipping damage and manufacturer defects are handled differently.
Shipping damage must be documented promptly with photographs, packaging, carrier paperwork, and timely notice to us.
Manufacturer defects may be subject to the manufacturer’s warranty process, inspection, repair, replacement, parts shipment, or other solution determined by the manufacturer or by us, as applicable.
Do not install, burn, alter, repair, discard, or continue using a product that appears damaged, defective, incomplete, or incorrect unless the manufacturer or we instruct you in writing to do so. Installing, burning, modifying, using, or discarding a damaged or defective item may limit available remedies.

19. Return Policy

Eligible non-custom, non-burned, non-installed, non-used, non-special-order items may be returned within 30 days after receipt, subject to prior authorization, inspection, and approval.
You must contact our sales staff before returning any item. Unauthorized returns may be refused, returned to the sender, or processed subject to additional fees.
Returned items must be unused, unburned, uninstalled, unmodified, complete, in resalable condition, and returned with all original packaging, manuals, hardware, parts, accessories, and documentation.
We may reject a return or reduce the refund if an item is damaged, incomplete, installed, burned, used, altered, missing packaging, missing parts, not resalable, or returned without authorization.
Return freight is the customer’s responsibility unless we state otherwise in writing or when required by applicable law.
Refunds may be reduced by:
• Original outbound shipping and handling costs;
• Return shipping costs paid by us;
• Carrier fees;
• Missing parts or accessories;
• Damage;
• Packaging issues;
• A restocking fee of up to 20%; and/or
• Other costs incurred because of the return.
If an item was sold with “free shipping,” the actual outbound shipping cost may still be deducted from the refund where permitted. “Free shipping” means the shipping cost was included in the product price or promotional offer and, therefore, paid by WoodstovePro.
Refunds will be issued after we receive and inspect the returned merchandise.

20. Non-Returnable and Non-Cancelable Items

The following items are final sale and are not returnable or cancelable once ordered, except as required by law or expressly approved by us in writing:
• Custom items;
• Burned, installed, used, altered, modified, or damaged items;
• Special-order items;
• Items marked special order, non-returnable, non-cancelable, or final sale on the website;
• Items identified in product-page notes as non-returnable or non-cancelable;
• Parts;
• Fireplace parts;
• FasNSeal products;
• Corr/Guard products;
• Oval-shaped pipe;
• B-vent pipe;
• Wyes and special fittings;
• Pipe or chimney products with a diameter of 12 inches or greater;
• 5-inch and 7-inch wood stove pipe;
• Items ordered based on customer-provided measurements, model numbers, serial numbers, part numbers, or compatibility information; and
• Any item that cannot be resold because of its condition, configuration, packaging, use, installation, or special-order nature.
Due to the specialized nature of parts, once a parts order is placed, we may not be able to cancel it, and we do not accept returns on parts except as required by law or expressly approved by us in writing.
You are responsible for confirming make, model, serial number, dimensions, compatibility, configuration, and part number before ordering.

21. Order Cancellations

Orders may enter processing quickly and may not be canceled once submitted. This is especially true for parts, special-order items, custom items, manufacturer-direct shipments, distributor-direct shipments, and freight items.
A cancellation request is not effective unless we confirm the cancellation in writing. If an order has already been processed, packed, shipped, released to a distributor or manufacturer, placed into production, or otherwise committed, cancellation may not be available.
If cancellation is approved, the refund may be reduced by costs already incurred, including manufacturer fees, distributor fees, payment-processing costs, shipping costs, return freight, restocking fees, or other applicable charges.

22. Refused Shipments and Failed Delivery

If you refuse delivery without our prior written authorization, fail to accept delivery, miss delivery appointments, provide an incorrect address, or otherwise cause a shipment to be returned, you may be responsible for all related costs.
These costs may include outbound shipping, return shipping, storage, re-delivery, carrier fees, restocking fees, and other charges. Refunds, if any, may be reduced by these amounts.
Refusing a shipment due to visible freight damage may be appropriate in some cases, but you must document the damage on the carrier's paperwork and contact us immediately.

23. Manufacturer Warranties

Products may be covered by a manufacturer’s warranty. Warranty terms vary by manufacturer and product.
Our sales staff will make reasonable efforts to help customers submit valid manufacturer warranty claims. However, warranty decisions are made by the manufacturer unless we expressly state otherwise in writing.
We are not responsible for manufacturer warranty approvals, denials, delays, labor charges, diagnostic fees, installation costs, removal costs, reinstallation costs, service calls, replacement freight, return freight, loss of use, project delays, or other costs associated with warranty claims, except where required by law or expressly agreed by us in writing.
To submit a warranty claim, you must provide all requested information, which may include proof of purchase, customer number, make, model, serial number, photographs, installation details, product labels, description of the issue, and any other information requested by the manufacturer or us.
Failure to provide the requested information may delay or prevent warranty processing.

24. No Additional Seller Warranty

Except for any written warranty expressly provided by us, and except as required by applicable law, we make no separate warranty beyond any applicable manufacturer's warranty.
To the fullest extent permitted by law, products are provided subject to the manufacturer’s specifications and warranty, if any. We do not guarantee that a product will be compatible with your appliance, installation, local code, building conditions, measurements, venting system, chimney system, or intended use unless we expressly state otherwise in writing.
Nothing in these Terms limits any warranty rights that cannot be waived under applicable law.

25. Safety Notices and Recalls

We may contact you regarding product safety notices, recalls, manufacturer updates, compatibility concerns, corrective actions, or other safety-related matters.
You agree to provide accurate contact information and to review and follow any safety notices, recall instructions, manufacturer bulletins, corrective-action instructions, or other safety communications provided by us, the manufacturer, distributor, carrier, or regulatory authority.
You should not use, install, sell, transfer, or continue using a product that is subject to a safety notice, recall, stop-use notice, or similar warning unless instructed that it is safe to do so.

26. SMS / Text Messaging Consent

By providing your mobile number and checking the SMS consent box, you agree that WoodStovePro/E-Prosites may send text messages to that number regarding your inquiries, orders, delivery, customer service, warranty matters, and related account or transaction issues.
Message frequency may vary. Message and data rates may apply. Consent to receive text messages is not a condition of purchase.
You may opt out at any time by replying STOP, CANCEL, END, UNSUBSCRIBE, QUIT, OPT OUT, or by using any other reasonable method that clearly communicates your desire not to receive further text messages. You may request help by replying HELP or contacting us directly.
After opting out, you may receive a one-time confirmation message. We will not knowingly send marketing text messages unless you have provided consent required by law.
Carriers are not liable for delayed or undelivered messages.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of use, lost profits, lost business, substitute goods, labor costs, contractor fees, service-call fees, installation costs, removal costs, reinstallation costs, diagnostic fees, project delays, property damage caused by improper installation or use, or delay-related damages.
Nothing in these Terms limits liability that cannot be limited under applicable law.

32. Customer Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless WoodStovePro, E-Prosites, their owners, officers, employees, contractors, suppliers, distributors, manufacturers, service providers, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
• Your inaccurate, incomplete, or misleading information;
• Incorrect measurements;
• Improper product selection;
• Incompatible parts;
• Installation errors;
• Modification, misuse, or improper maintenance;
• Code violations;
• Failure to obtain permits or inspections;
• Failure to follow manufacturer instructions;
• Failure to inspect or document freight damage;
• Refused shipments or failed delivery;
• Resale, transfer, or misuse of products;
• Your breach of these Terms; or
• Your violation of law or third-party rights.

33. Force Majeure

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including acts of God, severe weather, fire, flood, natural disasters, labor disputes, carrier delays, manufacturer delays, distributor delays, supply shortages, accidents, war, terrorism, civil unrest, government action, tariffs, import delays, power outages, internet outages, cyber incidents, pandemics, epidemics, or other circumstances beyond our reasonable control.

34. Governing Law and Venue

These Terms and any dispute arising out of or relating to the website, an order, product, shipment, return, warranty claim, communication, or relationship with us will be governed by the laws of the State of Ohio, without regard to conflict-of-law rules.
To the fullest extent permitted by law, the state and federal courts located in Summit County, Ohio, will have exclusive jurisdiction and venue for any dispute, and you consent to personal jurisdiction in those courts.
Nothing in this section prevents either party from bringing an individual claim in small-claims court, where permitted by law.
